SNSの法的問題と欧米における自主規制による対応

インターネット上のウェブサービスの中でもSNS(Social Networking Service)は多くの利用者数を獲得しているが、特に青少年の利用者増加に伴い、様々な課題も生じ始めている。他のウェブサービスと比較してSNSに顕著なのは、SNS上に掲載される個人情報をいかに保護するかという問題と、青少年を有害なコンテンツや不適切な接触からいかにして保護するかという問題である。
本稿では、SNSに関わる各種の法的課題の整理を行った後、EUおよび米国の取り組みを概観し、我が国の今後の対応に対する一定の示唆を提示する。

While SNS(Social Network Services)have proved to be amongst the most popular uses of the Internet today, the technology has also highlighted some serious issues, particularly related to the increasing number of young users. While Internet services have regularly raised social issues, those related to SNS have two distinct features. The first is related to protecting personal data, and the second concerns preventing children from being exposed to harmful content and inappropriate contact while using the services. These issues are problematic because they relate to the fundamental right of freedom of expression, and are also heavily influenced by the speed of technological change and changing usage of the particular services.
