EUの国際ローミング規制について

1999年7月、欧州委員会は、EU競争法の電気通信分野への適用に関する調査を開始し、携帯電話の国際ローミングもその対象に含まれた。この結果等を踏まえて、2004年から2005年にかけて、欧州の携帯電話事業者の一部に対してEU競争法違反の疑いにより、調査を実施した。
その後も欧州委員会は、国際ローミング料金が不当に高いとの認識に基づき、国際ローミングへの規制策の検討を継続し、2007年6月には国際ローミング規則を制定し、音声通話のローミング料金に上限を設定する等の規制を導入した。
2009年7月に国際ローミング規則は改正され、従来の音声通話に加え、SMSやデータサービスのローミングの料金にも上限を設定する等、規制を更に強化した。
2011年7月には、欧州委員会は、国際ローミングに対する更なる規制強化案を発表したが、本稿では、ここに至るまでのEUにおける国際ローミング規制の歴史を振り返る。

In July 1999 the European Commission began investigating whether the telecommunications market in Europe, including international mobile roaming services, was competitive under the terms outlined in EU Competition Law. On the basis of the evidence gathered during the investigation, three mobile operators in the UK and Germany were scrutinized as potentially abusing their dominant power in the international roaming market.
Amongst the findings, the Commission recognized that the international roaming prices were unreasonably expensive, and went further to consider how to regulate these roaming services. With the aim of capping international mobile roaming charges for voice calls, in June 2007 the EU International Roaming Regulation was implemented. In July 2009, the regulation was amended to also cap the charges for SMS and data services in addition to voice calls. Most recently in July 2011, the Commission proposed further strengthening the regulations for international roaming, and these amendments are scheduled for introduction in the summer of 2012.
This article will review the history of the EU’s international roaming regulations, and describe how they have worked to reduce the high cost of using the service.
