情報社会における公私の共同規制についての基礎的考察 ―背景、構造要件、リスク、政府関与―

筆者はこれまで複数の論考において、情報通信の発展に対応した制度を整備するにあたり「自主規制」が重要な地位を占めることを記述してきた。本稿では、自主規制という政策手段、そしてそれに対する一定の公的関与を伴う「共同規制（co-regulation）」という概念そのものに焦点を当て、それが必要とされる背景、機能するための構造要件、リスク、自主規制に対する政府関与のあり方、そして我が国の今後の法政策に対する含意を論じていく。

Increasingly, legal issues in the information society are focusing on the question of "who" should create the rules for the Internet, rather than "what" rules should be made. The answer to such a question lies not in either government or market acting independently; instead, what is required is collaboration between the government and market. This article builds upon a number of previous works related to the growing importance of "co-regulation" for the Internet. Co-regulation combines both self-regulation and government regulation, and is best understood as a mixed approach to rulemaking for the various legal issues in the information society, such as copyright and privacy.
